I never met anyone who wanted to suffer physical or economic injury. On occasion the injury suffered is due to the negligence of a third party. When such an unfortunate event occurs it results in a disruption of life. One’s health can be negatively affected either temporarily or permanently. More serious cases can result in loss of capacity to earn money, disfigurement and even death.

A personal injury attorneys role is to first evaluate the negligence. Sometimes the injured party shares some fault. Then we evaluate the extent of injury. These two issues are blended together to arrive at a settlement range which represents fair and reasonable compensation to reimburse the injury victim for their loss.

There is always disagreement initially between values suggested by the victim’s attorney and the insurance representative. Through the process of negotiation wherein the weaknesses and strengths of the case are explored, the parties attempt to narrow their differences.

If the negotiation process does not result in settlement, mediation or arbitration may be utilized if both sides agree. This process introduces a third party into the process in an attempt to bring the parties together. If this does not result in settlement, then the final option is litigation, where a judge or jury decided the issues.
