Third Parties and Workers’ Compensation Law
If you as an employee are injured on the job due to a defective piece of equipment, you as an employee who accepted workers’ compensation cannot sue the company, but could file a claim against a negligent third party, such as a manufacturer of equipment, a premisis owner other than the employer or a motor vehicle operator.
